Bankruptcy Explained
Chapter 7 and Chapter 13 are two separate bankruptcy processes. To determine which type of bankruptcy may be right for you, speak to a lawyer:
- Chapter 7 bankruptcy is commonly referred to as "liquidation bankruptcy". In this process, an individual's debt is eliminated and certain assets are sold off to repay creditors. A means test determines whether an individual is eligible to file for Chapter 7 bankruptcy. If not, Chapter 13 bankruptcy may be an option.
- Chapter 13 bankruptcy reorganizes an individual's debt and establishes a plan for settling that debt. An individual may be required to repay a portion of all of his/her debt over a period of three to five years.
As soon as an individual files for bankruptcy, an automatic stay goes into effect. This bans creditors from taking any actions against a debtor, which means harassing phone calls and other collection actions will stop.
